Officials checked the collection dates of used oil filters and the registration numbers of the vehicle that removed the waste. It turned out that the transport company did not have an up-to-date entry in Section VII of the BDO system, which automatically burdened the workshop with a fine of 5,300 PLN. The owner tried to explain that it was a subcontractor's error, but the regulations are clear – the obligation to verify a partner before handing over the goods lies with the waste producer.

The problem was that the workshop did not have written confirmation of checking the contractor in the public register. Inspectors considered this a gross negligence of reporting duties. The owner thought that since he paid annual fees and submitted reports, everything was fine. However, during a cross-check at one of his recipients, the tax office noticed that the required registration number was missing on 47 invoices from the previous quarter. The case was forwarded to the appropriate inspectorate, which imposed a fine of 12,400 PLN. This is a classic example where a small oversight in the accounting software settings generates costs in the thousands.

According to the Waste Act, every company entered in the register must place its number on VAT invoices, fiscal receipts, and contracts. At SRC, we encountered 12 similar cases in 2023 alone. In June 2024, exactly on Tuesday at 9:15 AM, two inspectors entered a trading company in the center of Lublin. They did not warn about the visit, which is consistent with the new environmental protection regulations. The owner was at a meeting with a supplier, so the warehouseman had to lead the inspection. This was the first mistake, as the employee was not trained in inspection procedures. Officials quickly noticed that 156 delivery boxes were stored outside without proper protection from rain, which was considered illegal waste storage outside a designated area.

The penalty for this one offense could have been up to 50,000 PLN, but thanks to our quick intervention and providing evidence that it was an emergency situation related to a warehouse gate failure, we managed to get down to a 4,800 PLN fine. It's still a large amount for a few hours of mess in the yard. In the case described from June, photos of wet boxes became key evidence in the case. If the company had signed a contract with Sarmatia Risk Control earlier, they would have known that covering this waste with an ordinary 80 PLN tarp was enough to avoid the penalty. A concrete defense consists of knowing the procedures that officials must follow – they often make mistakes when entering data into the protocol themselves, which allows us to effectively appeal.

How to check your company in 15 minutes?

Most penalties in 2024 result from ignorance, not the bad will of entrepreneurs. To avoid the fate of unfortunate companies from Lublin, it's worth conducting a quick internal audit. The first step is to check if the BDO number is in the footer of every invoice issued since January. The second step is to verify Waste Transfer Notes (KPO) from the last 6 months. Every mass removed from the company must match exactly what appears in the electronic system down to the kilogram. If the difference is more than 3.2%, the office may consider it an attempt at fraud.

The third element is to check contracts with waste collection companies. Are they authorized for the waste codes you hand over to them?
